| KUGAN – A SYMBOL OF POLICE BRUTALITY Posted: 13 Jan 2012 02:54 PM PST I had in some earlier articles mentioned the name Kugan; a 23 year old Indian boy who was found dead in police custody some three years ago in the Taipan police station, Subang Jaya. The name is now a symbol of police brutality that is commonly associated with dictatorial regimes. I am glad that the case is once again brought to public notice by the lawyers representing Kugan's family members who has sought that justice be brought against those responsible for Kugan's death. Having seen photos of Kugan's dead body, I am very certain that he did not die a natural death as the police had alleged; rather Kugan had died a violent death of beatings and torture, all in the hands of the police. Surely Kugan did not beat himself to death; just like the Anwar's black eye incident where the IGP then had said that the black eye was self inflicted; only to know later that the IGP was a blatant liar. Till this day, I cannot understand nor could I accept the lies perpetrated by those that had caused the death of Kugan; directly or otherwise. Everyone, from the police to the doctors that had examined the body of Kugan had lied through and through, without any sense of guilt and fear that they all will be answerable and questioned in their graves. Yes, they may escape the wrath of the law now because of the power they yield, but one has to believe that God's punishment in the hereafter is most severe. As I have said before, those who had caused Kugan's death and the death of the hundreds more in police custody can have their freedom today, but their guilt cannot escape them. With blood in their hands, it will linger in their minds and hearts till they finally face the Creator. As the lawyer of the family of Kugan had said that this is the most heinous crime committed by the police upon a yet to be proven offender, but the police finds it irrelevant to take up the case to prosecute the murders despite the knowledge that a grievous crime had occurred under their charge. Till this day, not a single person has been charge and the case remained unheard; safe in the vaults of the Taipan police station. For all we know, all the files may have gone missing. I can now appreciate and understand the reason why retired senior police officer Datuk Mat Zain Ibrahim is so vehemently passionate and persistent to bring to justice the abuses, fabrication and misconduct by AG Gani Patail and former IGP Musa Hassan, particularly in the case involving Anwar Ibrahim black eye incident of 1998. Despite the evidences detailed out by Datuk Mat Zain Ibrahim in several revelations against the two to the media, nothing has been done, let alone be acted upon by the relevant authorities in the government. The silence is indeed deafening, but this is the sorry state of affairs of the nation today where the powerful rules as it wishes and they do absolutely no wrong. It is only the weak and meek that get to answer for the slightest mistakes made. And as Anwar Ibrahim would say, "a policeman that takes RM50 from someone is called corruption, but for the well connected, taking RM500 million is called commission". I do not believe that under the present regime, Datuk Mat Zain Ibrahim's lone voice of reason will ever be heard. There is too much at stake and if all the allegations are to be heard, then those in power today and the past would have a lot to answer. Finally, let's hope that Kugan's family gets the justice that they so deserve. Likewise, the hundreds more that had mysteriously died in police custody. The same can also be said of the death of Teoh Beng Hock and Ahmad Sharbani whose cause of death too remains a mystery that makes a good Bollywood movie. And how many more mysterious deaths will continue occur in the hands of the authorities before we Malaysians can finally be assured that justice has no bounds and limits – rather justice is equal for all. | Ismail Kamus Akui PAS Diselubungi Api Fitnah?

| Posted: 13 Jan 2012 04:48 AM PST I can only say, CONGRATULATIONS to Penang CM Lim Guan Eng for being the first state government to have all the Exco members declare publicly their personal assets. This is a fine example of what leadership is all about – truthful and honest to the people that had voted them in? It takes a Chinese CM to do what a Malay CM or PM should be doing all along, and aren't the Malay leaders, especially UMNO leaders that has held the reins of power for more than five decades not ashamed? If CM Lim Guan Eng has the courage to order his Exco members to declare their personal assets, why can't PM Najib do it to all his ministers, deputy ministers and secretaries? And mind you, the declaration can be viewed by everyone in the state government's web page. The answer to above question posed is simple – CM Lim Guan Eng isn't corrupt and he does not have the wealth to boast around. No Bali-like palatial home, no exclusive German made imported cars (not one but many) and no private holidays and world trips travelling on First Class at public expense. Can we say that of our UMNO/BN leaders? Surely no – and we have seen examples of the luxuries enjoyed by some UMNO/BN leaders that we know isn't from their honest and hard earned earnings. I think CM Lim Guan Eng leadership example is more Muslim than most Muslims in this country has shown themselves to be. CM Lim Guan Eng has shown to us what a PR government should be doing in projecting its leaders as trustworthy and honest elected representatives. My only desire is to see the remaining three PR state governments do likewise, and I am quite sure this will appeal to the electorates. I do not think the present UMNO/BN leadership has the will nor the desire to do what CM Lim Guan Eng had done. They can no longer hide their wealth because it is too obvious. Please don't get me wrong here. I am not implying that all UMNO/BN leaders are corrupt and unscrupulous, because I know some are God fearing and plain honest. I do not wish to name them here; neither do I wish to list those that are unscrupulous. I think everyone knows how to distinguish the good from the bad. To CM Lim Guan Eng, let me tell you this. Please keep up the good and exemplary work. As a Malay, I salute you for your honesty, sincerity, will and commitment to transform Penang into a state that is free of corruption. We have not had this for the last 50 odd years and the example that you have shown, I am sure will be a 'pace setter' for other PR state governments to emulate. CRUSADE AGAINST CORRUPTION |

| This bogeyman is real... and really interested... Posted: 13 Jan 2012 02:29 AM PST According to Wikipedia: 'A bogeyman (also spelled bogieman, boogeyman or boogieman) is an amorphous imaginary being used by adults to frighten children into compliant behaviour.' I can still remember my sister-in-law used tell her little children who would not listen, that 'Ahnehneh will come to take him or her away'. A man was riding a bus, minding his own business, when the gorgeous woman next to him started to breastfeed her baby. The baby wouldn't take it, so she said, "Come on, eat it all up or ... I'll have to give it to this nice man here." Five minutes later, the baby was still not feeding, so she said, "Come on, honey. Take it or I'll give it to this nice man here." A few minutes later, the anxious man blurted out, "Come on, kid. Make up your mind! I was supposed to get off four stops ago!" |

| Penang Excos asset declaration posted online Posted: 12 Jan 2012 11:45 PM PST January 13, 2012 Star GEORGE TOWN: The Penang government has uploaded the asset declarations of its 11 executive councillors online for public scrutiny. The declarations can be access at www.penang.gov.my Chief Minister Lim Guan Eng said the information was uploaded Thursday. He said the state exco members, who hold positions of public trust, believed that the rakyat has a right to demand accountability from them. "The public declaration of assets fulfils the personal obligation of Pakatan Rakyat leaders and political commitment of the Penang Pakatan government towards reinforcing leadership with integrity in line with the principles of Competency, Accountability, Transparency. "For the first time in Malaysian history, the public declaration of assets was conducted not by the state government but by an independent audit company," Lim said Thursday. He said the Penang exco members wished to stress that they have no other sources of income, except from their public allowances as public officials and state assemblymen. "Their allowances can be obtained from the Enakmen Anggota Pentadbiran dan Ahli Dewan Undangan Negeri(Saraan) 1980," he added. This posting includes an audio/video/photo media file: Download Now |
| Guan Eng moves to compel EC into holding local govt elections Posted: 12 Jan 2012 11:43 PM PST 13 January 2012 by Lim Guan Eng In 1956, George Town became the first local council in the country to have a fully elected council with the president elected from among the councillors. In 1965, local government elections in Malaysia were suspended. The official reasons given was that the country was facing the threat of Confrontation initiated by Indonesia. The Local Government Act passed in 1976 , provided for only appointed councillors and presidents (Section 10) and was adopted by the Penang State Government. All councillors, including the presidents were appointed by the state government of the day. One of DAP's key agenda is the restoration of local government elections. The Penang PR state government has pressed for local government elections to enable councillors and mayors to be directly elected ever since we took power in 2008. Amongst some of the efforts taken by the Penang State Government to restore the third vote(after vote for parliament and state seats) are as follows:- 1. On 11/8/2009 The Penang State Government moved a resolution in the State Assembly calling on the Federal Government to bring back local government elections. This was passed by the Penang state assembly. 2. The State Government also engaged a 3 panel lawyer Dato Yeo Yang Poh, Mr Tommy Thomas and Malik Imtiaz and to provide legal opinion to the Penang State Government or our rights and powers to compel local government elections to be held. 3. The Penang State Government wrote a letter to National Council of Local Government (NCLG) under Article 95A of the Federal Constitution NCLG date on 13/7/2009 and requested bring up the topic of local government elections in this council. However the NCLG, rejected the State's request. 4. Based on the advice of the 3 panel lawyers, I wrote to the Election Commission on behalf of Penang State Government on 4/3/2010 requesting the Election Commission to conduct local government elections. Under Article 113 (4) Federal Constitution, it is explicitly state that Federal or State law may authorise the Election Commission to conduct elections other than those referred to in Clause (1). As Clause 1 refers to parliamentary and state seats, clearly the state government has jurisdiction over whether to hold election for municipal seats since local government is under the State list. The Ninth Schedule of the Federal Constitution of powers within the State List explicitly states that the state government decides over local government elections. 5. The reply by Election Commission dated 23 March 2010 to the Penang State Government rejecting the Penang State government's request to restore Local Government Elections is disappointing. The Penang state government has no choice but to institute legal proceedings to compel the Election Commission to comply wth the state government's directive to conduct local government elections. As a first step, the Penang State Government has been advised by Tommy Thomas, at a meeting with Tommy Thomas and some EXCO members yesterday, to first negate Section 15 of the Local Government Act 1976. Section 15 states: "Not withstanding anything to the contrary contained in any written law, all provisions relating to local government elections shall cease to have force or effect." In other words section 15 nullified all local government elections. Tommy Thomas has also advised that the State government issue a Gazette notification exempting all the local authorities within Penang from applying Section 15 of the Local Government Act. This would result in section 15 not being applicable in Penang and is the first step towards seeking a court declaration to compel the Election Commission to conduct local government elections. I will be proposing at the next EXCO meeting next week directing the State Legal Advisor to issue this gazette notification. This is a necessary precursor to take the issue to court to seek a declaration, which will be conducted by Tommy Thomas. |

| Gempar! (Pic by Afiq Razali) Source: http://thestar.com.my/metro/story.asp?file=/2012/1/13/central/10244925&sec=central (By Vincent Tan, 13.1.2012)Residents of the Nova 1 condominium in Taman Sri Sinar, Kuala Lumpur breathed slightly easier on Jan 11, as contractors appointed by the Kuala Lumpur City Hall (DBKL) arrived that morning to shore up an eroding slope next to their residence. According to Patrick Chan Yew Choong, a member of Nova 1's management corporation (MC), the soil erosion was taking place on the piece of land next to Nova 1. Residents feared if the erosion continued, it could have negative consequences for the land which Nova 1 was built on. Pointing to the retaining wall which separated Nova 1 from the road, he said further erosion could cause the wall to crack, and give way if corrective action was not taken. "If the retaining wall goes, then the land which Nova 1 is built will erode too," said Chan. However, MC chairman Manoharan Dhanaraj said DBKL did not take any corrective action despite repeated enquiries from the residents. "The slope started eroding, then we noticed that the concrete drain had cracked and collapsed back in March 2011. We reported the matter to DBKL in May last year, whereby we were given a report number as well as the contact details of the people handling this case." "What DBKL did in the last week of December, was to put up canvas sheets to prevent more rain from eroding the soil. We had to seek the assistance of Segambut MP Lim Lip Eng," he added. Lim said after discussions with the residents on Jan 4, he took up the matter with DBKL the next day. "On Jan 6, they informed me that they will start work on Jan 9. They sent people down to assess the situation and they started moving in material to repair the collapsed drain walls," said Lim. Lim hoped the repairs would be completed quickly, to minimise further erosion from the rain. According to Manoharan, the time estimated for repairs by the contractor was put at three weeks. There were other problems afflicting the slope, such as leaking pipe connectors belonging to a water pipe owned by Syarikat Bekalan Air Selangor (Syabas), which Manoharan and Chan theorised might have also led to the erosion problems on the slope. "We called Syabas about the leaking pipe connectors and they only replaced it recently. But they only replaced one, and not the other," Chan said.
